Terms Of Use ("Terms")

Please read these Terms of Use ("Terms", "Terms of Use") carefully before using the http://www.eyecura.com.au website and the EyeCura mobile application (the "Service") operated by EyeCura ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Payment

You agree to pay all applicable fees, if any, for your access to and use of the EyeCura Site and services, as specified in EyeCura’s then-current Fees and Payment Policy. Unless otherwise provided in the Fees and Payment Policy, payment for all services is due at the time the service is requested. EyeCura may change the fees and other aspects of the Fees and Payment Policy at any time by providing 30 days prior notice, effective upon posting. All fees are exclusive of sales, use, excise or any other taxes, and you are responsible for all such taxes except those based on EyeCura’s net income or assets. Payment obligations cannot be cancelled, and no payments are refundable. You must provide EyeCura with valid credit card information when registering for the EyeCura Site Website and its services, and you must notify EyeCura in advance of any change in that information. Where applicable, EyeCura charges and collects in advance for use of the EyeCura Site and its services. EyeCura will automatically renew and bill your credit card or issue an invoice to you each year on the subsequent anniversary or as otherwise mutually agreed upon. Failure by EyeCura to receive payment in full when due will entitle us to suspend or terminate your account.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for:

1. You are 16 years of age or older.
2. You understand that EyeCura DOES NOT become involved in transactions or actions between or amongst parties and does not certify, investigate, or in any way guarantee the legal capacity of any party to transact.
3. You are responsible for obeying all applicable enforcement mechanisms, including, but not limited to federal, state, municipal, and tribal statutes, rules, regulations, ordinances, and judicial decisions, any applicable executive orders, including compliance with all applicable privacy protection requirements.
4. You will not use EyeCura’s Services or EyeCura.com.au for any illegal purpose.
5. You consent to having your personal data transferred to and processed in Australia, UK and USA.

We do our best to keep EyeCura safe, but we cannot guarantee it. We need your help to keep EyeCura safe, which includes the following commitments by you:

1. You will not collect Users’ content or Personal Information, or otherwise access EyeCura, using automated means (including, but not limited to, harvesting bots, robots, spiders, or scrapers) without our prior written permission.
2. You will not upload viruses or other malicious code.
3. You will not solicit login information or access an account belonging to someone else. You will not bully, intimidate, or harass any User.
4. You will not post content on EyeCura that: is hate speech, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence.
5. You will not develop or operate on EyeCura a third-party application containing alcohol-related, dating or other mature content.
6. You will not use EyeCura to do anything unlawful, misleading, malicious, or discriminatory.
7. You will not do anything that could disable, overburden, or impair the proper working or appearance of EyeCura, such as a denial of Services attack or interference with page rendering or other EyeCura functionality.
8. You will not facilitate or encourage any violations of this Agreement or our policies.

You must provide us with your real personal information. Additionally, to further ensure account liability and registration security, you must adhere to the following conditions

• You may never use another User’s account without their permission.
• When creating your own account, you must provide accurate and complete information. You will keep your contact information accurate and up-to-date.
• You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You will not share your password, let anyone else access your account without your permission, or do anything else that might jeopardize the security of your account.
• If we disable your account, you will not create another one without our written permission.
• You will not use EyeCura if you are a convicted sex offender.
• You will not transfer your account to anyone without first getting our written permission.
• If you select a username or similar identifier for your account, we reserve the right to remove or reclaim it if we believe it is appropriate (such as when a username may infringe the rights of a trademark owner).
• You will provide EyeCura an email address of which you consent to our use of that email address to send you Services-related notices, including any notices required by law, in lieu of communication by postal mail.

You must notify EyeCura immediately of any breach of security or unauthorized use of your account. EyeCura will not be liable for any losses caused by any unauthorized use of your account.

You will not provide any false personal information on EyeCura, or create an account for anyone other than yourself.

You are solely responsible for any and all consequences of such your actions. You further acknowledge and understand that in the event that you violate these terms, EyeCura may permanently remove you from the Services or the site, and depending on the nature and severity of the violation, avail itself of such remedies as are prescribed by law. EyeCura will comply with applicable federal, state, provincial, municipal, and tribal law enforcement entities pursuant to applicable laws and regulations. You must take responsibility for your actions whilst using EyeCura.com.au and take responsibility for any and all of your actions related to, or resulting from, my use of EyeCura.com.au

EyeCura has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that EyeCura shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
